Commercial License Agreement

Introduction

This license is a legal agreement between you (referred also as "you" or "buyer" or "user" or "software user") and the author of the software, Constantin Bejenaru, including subsidiaries and affiliates (referred also as "Author" or "Owner" or "we" or "I" or "us" or "me" or "our" or "mine"). By paying, downloading and using any software (including small code snippets, modules or other pieces of code) you agree to be bound by the terms and conditions of this license, unless otherwise noted. The author, Constantin Bejenaru, reserves the right to alter this agreement at any time, for any reason, without notice.

Permitted Use

Users of commercial licensed software, may use it on a website engaging a commercial, or for-profit activities. One license grants the right to perform one installation of the Software. Each additional installation of the Software requires an additional purchased license.

Restrictions

Unless you have been granted prior, written consent from the author of the software, Constantin Bejenaru, you may not:

Reproduce, distribute, or transfer the Software, or portions thereof, to any third party.
Sell, rent, lease, assign, or sublet the Software or portions thereof.
Grant rights to any other person.
Use the Software in violation of any Romanian or international law or regulation.

Display of Copyright Notices

All copyright and proprietary notices, including logos, within the Software files must remain intact.

Giving Credit

There might be certain public parts on your website where the Software displays informations about the author and other details including a link pointing to http://www.frozenminds.com/ . Usually this is only commented text and is not visible directly to your users/website visitors. There is no requirement for you to keep them.

Making Copies

You may make copies of the Software for back-up purposes, provided that you reproduce the Software in its original form and with all proprietary notices on the back-up copy.

You may install and use the Software on a second server/computer, for testing or development purposes only. This permission is granted as long as the testing/development environment is not open to the public.

Software Modification

You may alter, modify, or extend the Software for your own use, or commission a third-party to perform modifications for you, but you may not resell, redistribute or transfer the modified or derivative version without prior written consent from the author, Constantin Bejenaru. Components from the Software may not be extracted and used in other programs without prior written consent from the author.

Technical support might be available only through the website at www.frozenminds.com, unless otherwise noted. The author does NOT provide direct email or phone support. No representations or guarantees are made regarding the response time in which support questions are answered.

Refunds

Due to the non-returnable nature of downloadable software, the author Constantin Bejenaru, does NOT issue refunds once a transaction has been completed. You are encouraged to ask for Software requiremens and test an online demonstration (if available through the website at www.frozenminds.com) before making a purchase. The author may not be held responsible for you server and/or website configuration or misconfiguration. Once paid, there is NO refund even if the Software may not work for you as expected.

Indemnity

You agree to indemnify and hold harmless the author, Constantin Bejenaru, for any third-party claims, actions or suits, as well as any related expenses, liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this license.

FURTHER, THE AUTHOR DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED SERVICE WILL ALWAYS BE AVAILABLE.

Limitations Of Liability
